Department of Personnel & Training on 15th March, 2011, wherein staff side was asked to furnish the details in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme we have submitted our case to the Secretary Staff Side, National Council (JCM). Please refer to the summery of discussion issued by the DOP&T vide letter no.- 11/1/2010-JCA dated 20-04-2011 in respect of the third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15th March, 2011. We appreciate the efforts made by the staff Side for pursuing the agenda items. In this connection we would like to draw your kind attention to the item numbers 1,3,8,9 & 29 Grant of financial upgradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS. Under this point in second para, it has been mentioned that “After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel & Training for further necessary action”.
In response to above we are submitting herewith the case of the Junior Engineers of Central Water Commission under Ministry of Water Resources. Due to Modified ACP Scheme Junior Engineers, who have not completed 24 years of service up to 31-8-2008, will be in total disadvantageous position than those who have already completed 24 years of service prior to 1st September 2008 and will have to bear with heavy financial losses.
Therefore it is requested that the information may kindly be forwarded to the DOP&T for further course of action. It would be in the interests of the employees, if the same are put forth for consideration at the time of review of the MACP Scheme.

Explanatory Note

Assured Career Progression Scheme was launched to provide reasonable opportunity to all employees to move to higher grade within a stipulated time frame. Financial upgradation was under the next higher grade in accordance with the existing hierarchy in a cadre /category of post.
In spite of that 6th CPC has overlooked all the facts & recommendations in respects of the much sufferer employees and recommended two financial upgradations in the Grade Pay hierarchy after 12 and 24 years. The recommendations were not justified. Most of the lower & middle level cadres in field formation are suffering from acute stagnation. While promotion are assured at the upper level, Government is unable to provide even two regular promotions to some section of employees in the lower and middle level during their entire service.
The case of the Junior Engineers of Central Water Commission is furnished below-
Due to the ‘shift’ in ‘principles & purposes’ of the Assured Career Progression in the MACPS, the pay scale/Grade pay of the Junior Engineers of Central Water Commission, who have not completed 24 years of service up to 31st August, 2008, will be fixed abnormally on lower side at H 4,800/- instead of in the grade pay of H 5,400/- which is continuously being given to all those JEs, who have completed 24 years of their services up to 31-8-2008 as per erstwhile ACP Scheme.
Promotional Channel in Central Water Commission for Engineering Cadre is as given below-
Entry Grade - Junior Engineer (Grade Pay H 4200 in PB-2)
To
Assistant Director-II/Sub Divisional Engineer (Grade Pay H 4600 in PB-2)
To
Assistant Director/Assistant Executive Engineer (Grade Pay H 5400 in PB-3)
To
Deputy Director/Executive Engineer (Grade Pay H 6600 in PB-3)
Hence upgradations under ACP Scheme 1999 were as below
At initial appointment PB-2 with Grade Pay H 4200
1st regular promotion/ACP after 12 years PB-2 with Grade Pay H 46002nd regular promotion/ACP after 24 years PB-3 with Grade Pay H 5400
Upgradations under Modified ACP Scheme 2009 are as below
At initial appointment PB-2 with Grade Pay H 4200
First MACP after 10 years PB-2 with Grade Pay H 4600Second MACP after 20 years PB-2 with Grade Pay H 4800
Third MACP after 30 years PB-2 with Grade Pay H 5400
The Junior Engineers who were granted second ACP in the grade of H 5400 in PB-3 up to 31-08-2008, have been awarded 3rd MACP in the Grade of H 6600 on completion of 30 years of regular service.
Further the Grade Pay of H 4800 is not in the hierarchy of the engineering cadre or any other cadre in Central Water Commission except CSS/CSSS cadres. While recommending the pay structure in respect of CSS/CSSS cadres in Chapter 3.1 at page 161, 6th CPC has mentioned that “The grade carrying grade pay of Rs.4800 in pay band PB-2 is, otherwise, not to be treated as a regular grade and should not be extended to any other category of employees. These recommendations shall apply mutatis-mutandis to post of Private Secretary/equivalent in these services as well.”
It is clear from the above that the implementation of MACP Scheme has downgraded the Junior Engineers & they are getting huge loss due to this modified scheme even after serving such a long time to the Government. The Junior Engineers who could not complete 24 years up to 31-8-2008 will be given 3rd MACP in the Grade Pay of H 5400 in PB-2 on completion of 30 years of regular service whereas their counterparts who had completed 24 years of regular service prior to 1st September, 2008 were awarded the Grade Pay of H 5400 in PB-3 and on completion of 30 years they are getting Grade Pay of H 6600 in PB-3. This will lead to enhance the feeling of discontentment, unprecedented frustration, resentment and agitation in the affected Junior Engineers.
Promotional prospects must be perceived by an employee as being timely. If an employee is made to continue for long years in particular grade, and if he is not made aware that his performance is being reviewed periodically, he is likely to lose the motivation to excel himself. In the long run this would cause permanent irreparable damage to this category. Further it would also give doubt about the recognition of their services & completely demoralized them.
Junior Engineers in Central Water Commission are not getting promotion in the post based system even though they are eligible. For none of their mistake, they are severely punished in their social status as well as financial. In the present circumstances, generating number of promotional avenues under Govt. setup absolutely is not possible. Therefore, only Assured Career Progression may bring great relief to the employees to the larger extent, hence three MACPs in promotional hierarchy is the natural requirement.
The format of ACP which confers the next promotional grade in functional hierarchy must be restored with three financial upgradations after 10, 20 & 30 years.
Therefore the provisions of the MACP Scheme of the VI CPC may be reviewed & distortions may be corrected so as to remove these anomalies and adjudicate provide relief to the suffering cadre of the Junior Engineers in Central Water Commission under Ministry of Water Resources.
