Recruitment of Junior Engineer( Civil and Mechanical ) for Central Water Commission.

A notice issued by the Central Water Commission in respect of Newly recruited Junior Engineers has been placed at the CWC website. The same is reproduced below-

Ail candidates selected through Staff Selection Commission vide result declared on 24.09.2011 are hereby informed that till 30.11.2011 the Central Water Commission has received a list of 190 candidates out of 210 candidates from Staff Selection Commission The list for remaining candidates is expected from SSC shortly. After receipt of the complete list, the candidates shall be posted at suitable places on merit-cum-preference basis. This process is likely to be completed by end of December 2011.

POSTING ON PLACES OF CHOICE

Process of new recruitment of the Junior Engineers in Central Water Commission through Staff Selection Commission is almost completed. Appointment to the successful candidates are to be issued very shortly. Hence CWC has proposed to adjust the existing Junior Engineers to their places of choice. An Office Memorandum to the effect has been issued by CWC vide no. A-22012/3/2011-Estt.VI dated 30-11-2011.

Therefore, junior Engineers who desire their transfer to their home town/place of choice may submit application through proper channel immediately.

ORDERS FOR NON PRODUCTIVITY LINKED BONUS (AD-HOC) TO THE CENTRAL GOVERNMENT EMPLOYEES FOR THE YEAR 2010-11 ISSUED


Ministry of Finance, department of Expenditure has issued orders for Non Productivity Linked Bonus (Ad-hoc) to the Central Government Employees for the year 2010-11 vide OM No.7/24/2007/E III (A) dated 13th September, 2011. Amount of the bonus will be equivalent to 30 days emoluments for the accounting year 2010-11 in Group 'C' and 'D' and all non-gazetted employees in Group 'B', who are not covered by any Productivity Linked Bonus Scheme. The calculation ceiling of Rs. 3500/- will remain unchanged. The amount for thirty days would work out to Rs. 3500x30/30.4=Rs,3453.95 (rounded off to Rs.3454/-).

GRANT OF SECOND AND THIRD FINANCIAL UPGRADATION UNDER MACPS TO AD-II/SDE


Grant of second and third financial upgradation under MACPS to AD-II/SDE is being considered in the Central Water Commission. In this regard relevant information has to be furnished in respect of AD-II/SDE eligible upto 31.3.2012.

The information in the checklist is to be furnished from the service record of the concerned AD-II/SDE. The Checklist is to be signed by the concerned Executive Engineer and countersigned by the Superintending Engineer is to be submitted to Establishment-V alongwith Vigilance clearance.

PARLIAMENTARY PANEL RECOMMENDS HIKE IN THE RATE OF GPF

The Confederation of Central Government Employees & Workers has been demanding for the enhancement of the interest rate on the GPF of Central Government Employees. Now according to the PTI, a Parliamentary Panel headed by the former Finance Minister Sri. Yashwant Sinha has recommended hike to the GPF interest rates. A Parliamentary panel today asked the Central government to increase the rate of return on provident fund for its employees in the light of rising bank rates and EPFO's decision to hike its rate to 9.5% for 2010-11.

"The rate of interest on General Provident Fund (GPF) which is pegged at 8% may be reviewed so that government employees are not put to any disadvantage more so now when the interest rates for bank deposits has also been raised," the Standing Committee on Finance suggested in its report.

If the suggests of the panel finds favour from the government, over 50 lakh Centre's employees will stand to benifit.

The panel headed by former Finance Minister Yashwant Sinha, pointed out that retirement fund body Employees Provident Fund Organiation has also increased rate of interest on PF deposits to 9.5% for 2010-11 from 8%.

The EPFO had been paying 8.5% interest on PF deposits since 2005-06. In September last year, it had recommended an increase in interest rate to 9.5% for 2010-11 after discovering Rs 1,731 crore surplus in their books of accounts.
In the present scenario, the bank rates are also increasing. Reserve Bank of India has increased its short term lending and borrowing rates by half a percentage point to 8 and 7%, respectively in its recent quarterly review unveiled on July 26.

Following the central bank's rate hike, some private and public sector have also hiked their rates.

35TH MEETING OF THE DEPARTMENTAL COUNCIL (JCM) OF MOWR HELD ON 09-06-2011

35th Meeting of the Departmental Council (JCM) of MOWR was held on 09-06-2011 in the chairmanship of Secretary, MOWR. The following is the outcome of discussion of the points related to items of Association of Junior Engineers -

A. OLD ITEMS

1. Demand to revise the quantum of Investigation Allowance according to CPC recommendations.
It was told that as Ministry of Finance has rejected the proposal on the ground that the Investigation Allowance was not considered by the sixth CPC it will not be possible to process the case further. However CWC will submit the proposal for alternate allowance to compassionate the employees who were engaged in the investigation work.

2. Abolition of Junior Engineers posts in Central Water Commission adversely affecting the field setup.
For filling 210 vacancies of the Junior Engineers, Staff Selection Commission has conducted the exam on 1st May 2011. Selection of the candidates is under process. For revival of the 79 posts, which had gone under deemed abolition, the proposal has been submitted to MOWR. It has been told that the proposal will be submitted to IFD of MOWR within two weeks.

3. Demand to provide medical attendance Scheme for the GOI officials posted at Joint Project Office Sapt Kosi Sun Kosi Investigation, Nepal.
It was reported that the clarification has already been taken from the Ministry of Health. It has been reiterated that medical reimbursement claims of Indian Personnel of JPO-SKSKI, Nepal and their family members may be regulated as per the provision contained in MOWR dated 1st July 2003. Hence it is decided to drop this item.

4. Demand to fill up the promotional posts of Junior Time Scale in Central Water Commission for 2008-09 & 2009-10.
Order for filling of the vacancies related to 2008-09 and 2009-10 has already been issued. Proposal for filling up of the promotional vacancies caused in AEE/AD posts for the year 2010-11 & 2011-12 has been submitted to MOWR. MOWR will process the case further. As the convening of the DPC is an ongoing process, it is decided to drop this item.

5. Demand to amend the promotion hierarchy of Group ‘B’ Engineering cadre directly into Senior Time Scale like system followed in CPWD.
Secretary, MOWR directed CWC to submit the proposal within three months in consultation with staff side.

6. Time frame to settle the pension payment and other retirement dues of the field staff.
Staff side was unhappy in respect of delay in the pension related payments to the retiring staffs. After detailed discussion Secretary, MOWR directed all the Departments to submit the list of the employees to be retired within next six months so that the cases can be processed in advance. Controller of Accounts promised that if required, he will depute a team from the concerned PAO for speedy submission.

7. Demand to maintain GPF account on Web Site and to take appropriate action on missing credits.
It was reported by the Controller of Accounts, MOWR that all the missing credits will be mentioned in the GPF slips which will be issued by the 31st July 2011. In respect of putting the GPF account on Website he informed that the matter has already been taken up with the Controller General of Accounts.

8. Demand to enhance the allowance to the CWC employees serving at Bhutan/Nepal at par with the Staff serving in External Affairs Ministry.
Proposal for the revision of Pay Scale and allowances to the CWC staff working at Bhutan at par with other officials posted at Bhutan has been accepted by the MOWR. Secretary, MOWR told that our employees should also get the same emoluments which are being paid to the employees of other organizations. He directed CWC to submit the proposal so that the matter can be taken up with the MOF and MEA.

B. NEW ITEMS

1. Demand to implement MACP Scheme to the erstwhile Design Assistants and present AD-II/ SDE in CWC.
Regarding the matter DOP&T has given the consent but advised to confirm from the MOF. Hence the file has been submitted to the MOF. Decision of the Ministry of Finance is awaited. Secretary, MOWR directed the concerned officers to pursue the case.

MINUTES OF THE SUB COMMITTE & STANDING COMMITTEE MEETINGS OF 34TH MEETING OF DEPARTMENTAL COUNCIL (JCM) OF MOWR ISSUED

As we earlier informed that Sub Committee & Standing Committee meetings of the 35th Meeting of the Departmental Council of MOWR (JCM) were held on 29-04-2011 in the chairmanship of the Joint Secretary (A), MOWR. Minutes of meeting have been issued by the MOWR. Agenda items pertaining to Association of Junior Engineers are placed below-


OLD ITEMS

After discussion it was decided that CWC should examine the case in consultation with Staff Side and, if necessary, refer the case to the Ministry for further necessary action.

After discussion it was decided that CWC’s proposal will be reexamined and taken up further with the Ministry of Finance.

It was informed that DPC proposals for 2010-2011 & 2011-2012 have already been formulated by CWC and sent to the Ministry recently. After examination and checking up for receipt of supporting documents, proposal would be sent to UPSC shortly. Since convening of DPCs etc. are an ongoing process, it was proposed to drop this item.

Demand to amend the promotion hierarchy of Group `B' Engineering cadre directly into "Senior Time Scale" like the system followed in CPWD.
It was decided that Staff Side would give necessary proposal to CWC who would then examine and take further necessary action.

Time frame to settle the pension payment and other retirement dues of the field staff.
The Staff Side had given a list of pending cases and it was decided that the same will be verified and remedial action will be taken immediately. It was decided that annual retirement cases list will be prepared in advance. It was also decided that a team will be sent to Field Offices of CWC where maximum number of cases are pending and CWC will take up the matter with the PAO on the issue. If necessary, another group meeting should be convened to review the position.

Demand to maintain GPF account on Web site and to take appropriate action on missing credits.
After discussions, it was decided that the GPF Statement would be given on 31st July of the year to all officials. To address the Staff Side concerns regarding details of missing credits, JS (A) directed Controller of Accounts for giving information viz, no credit is missing for any month or details of missed credit for various months, as the case may be, in the GPF Statement. Staff side insisted to place the accounts through Website with the help of NIC. Copies of the GPF Accounts of the State Government employees through NIC were handed over to Comptroller of Accounts.

Revival of promotional scientific posts put under deemed abolition status & Restoration of operational Posts.
Staff side pointed out that there was no SIU study proposal as mentioned. After discussions, it was decided that CWC would resubmit the proposal to the Ministry.

Demand to enhance the allowance to the CWC employees serving at Bhutan /Nepal at par with Staff serving in the External Affairs Ministry.
After discussions, it was decided that the matter would be considered by CWC and CWC would sent appropriate proposal for taking up with Nodal Departments.

B. NEW ITEMS

Regarding the matter DOP&T has given the consent but advised to confirm from the MOF. Hence the file has been submitted to the MOF. Decision of the Ministry of Finance is awaited.

Demand to implement MACP Scheme to promotee Asst. Executive Engineer / Assistant Directors in Central Water Commission.
The item is not to be admitted. However, it was decided that matter regarding administrative action may be pursued.

Demand to change the crucial date for determining eligibility as 1st April instead of 1st January in Central Water Commission.
Since this is a policy matter pertaining to DOP&T, after discussion, it was decided not to admit this item.

Demand to implement MACP Scheme to the erstwhile Design Assistants and present AD-II/ SDE in CWC.
It was noted that the matter has already been taken up with the D/O Expenditure and decision in this regard is pending. It was decided to admit this item for discussion in the main meeting.

Demand to with draw the Departmental Test Conducted by CWC at AD II / SDE and AD/AEE level.
After discussion it was decided to transfer this item to Office Council.

Classification of post as per DOP&T OM No.1101217/2008-Estt. (A) 17th April, 2009.
In accordance with the DOPT OM No.1101217/2008-Estt. (A) 17th April, 2009 the post of Junior Engineer based on the revised norms of pay has been reclassified as Group ‘B’ w.e.f. 9th April 2009.

MINUTES OF THE 29TH MEETING OF OFFICE COUNCIL OF CWC ISSUED

29th Meeting of the office council of Central Water Commission was held on 26th April 2011 in the chairmanship of Chairman, Central Water Commission. Minutes of the same has been issued. Items related to Association of Junior Engineers are placed hereunder-

Demand to set up Screening Committee and implement modified ACP Scheme to eligible JEs/ SDE/AD as per DOP&T Office Memorandum
It was decided to drop the item in view of the progress reported in the actions taken.

Demand to fill up vacancies of SDE/AD-II by promoting JEs
It was decided to drop the item in view of the progress reported in the action taken. Leader, Staff Side thanked the Chair for advance DPC proceedings and implementation.

Demand to follow guidelines of DOP&T provided in Transfer Policy while transferring JEs/AEs on completion of their tenure under NE Region
It was decided to drop the item in view of the position .explained by CWC Administration that the guidelines in the transfer policy are being followed while posting AEs and JEs to other offices after their completion of tenure in NE Region.

Demand to avoid food bills in TA Bill of the field staff visiting field offices
It was decided that a decision on this demand be taken expeditiously (say within a month)

The meeting was informed that the proposal to delegate enhanced power to JEs to incur expenditure towards petty purchases is being sent to MoWR.

Distribution of staff strength of Group 'B' & 'C' Technical and Non- Technical under Field Offices
CWC Administration informed the meeting that the proposal of RMCD for re‑
distribution of the staff strength of Group 'B' and Group 'C', Technical and Non-technical Cadres in the field offices needs to be examined in detail. RMCD should make a formal reference to CWC Administration on the proposal for the purpose of its implementation to the extent merited/feasible.

GOVERNMENT TRASHES PROPOSAL TO INCREASE RETIREMENT AGE

May 22, 2011

As per news in Hindustan Times dated 22-05-2011 a government committee has rejected a proposal to increase the retirement age of government servants from 60 to 62. The decision is likely to impact over one lakh central government employees and 50,000 defence personnel on the verge of retirement. The proposal, which could have meant saving Rs 4,000 crore in this fiscal, was rejected as the government wants a younger bureaucracy.

HYDERABAD, MAY 16: STATING THAT CENTRAL GOVERNMENT EMPLOYEES WERE NOT HAPPY WITH THE RECOMMENDATIONS OF THE 6TH PAY COMMISSION, SK VYAS, PRESIDENT OF THE CONFEDERATION OF CENTRAL GOVERNMENT EMPLOYEES AND WORKERS (CCGEW), DEMANDED CONSTITUTION OF 7TH PAY COMMISSION TO RESOLVE PROBLEMS OF EMPLOYEES. HE WAS SPEAKING AT A STATE-LEVEL CONVENTION OF CCGEW HERE ON SUNDAY.

Order for promotion of the 73 Junior Engineers has been issued vide CWC no.- A-32013/1/2011-Estt.V/1169 dated 27-04-2011. Some transfers in the grade of Assistant Director-II/ SDE have also been ordered. DPC for the year 2010-11 and 2011-12 was held on 04-04-2011. Out of 73, 72 post belongs to the year 2010-11 and one post for the year 2011-12. For remaining posts orderw will be issued as & when the vacancy arises during 2011-12. CASE REGARDING MACP SUBMITTED TO THE SECRETARY STAFF SIDE , NATIONAL COUNCIL (JCM)


In response to the minutes issued by the DOP&T in respect of the third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15th March, 2011, wherein staff side was asked to furnish the details in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme we have submitted our case to the Secretary Staff Side, National Council (JCM). Sir,

Please refer to the summery of discussion issued by the DOP&T vide letter no.- 11/1/2010-JCA dated 20-04-2011 in respect of the third meeting of the Joint Committee constituted to examine the anomalies pertaining to the MACP scheme held under the Chairmanship of Joint Secretary (Estt.) Department of Personnel & Training on 15th March, 2011. We appreciate the efforts made by the staff Side for pursuing the agenda items. In this connection we would like to draw your kind attention to the item numbers 1,3,8,9 & 29 Grant of financial upgradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS.  Under this point in second para, it has been mentioned that After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel & Training for further necessary action”.

In response to above we are submitting herewith the case of the Junior Engineers of Central Water Commission under Ministry of Water Resources. Due to Modified ACP Scheme Junior Engineers, who have not completed 24 years of service up to 31-8-2008, will be in total disadvantageous position  than those who have already completed 24 years of service prior to 1st September 2008 and will have to bear with heavy financial losses.

Therefore it is requested that the information may kindly be forwarded to the DOP&T for further course of action. It would be in the interests of the employees, if the same are put forth for consideration at the time of review of the MACP Scheme.

Explanatory Note
------------------

Assured Career Progression Scheme was launched to provide reasonable opportunity to all employees to move to higher grade within a stipulated time frame. Financial upgradation was under the next higher grade in accordance with the existing hierarchy in a cadre /category of post.

 It was also assured that attempt should be made to improve the promotion prospects in an organization on functional grounds by way of orgnisational study, cadre reviews etc. Introduction of ACP should in no case affect the normal promotion avenues available on the basis of vacancies. Orgnisational study, cadre reviews etc should not be given up on the ground that Assured Career Progression Scheme has been introduced.

 But during the last twelve years no sincere efforts were made by the Government by the scheme of cadre reviews to improve the prospects of the large number of employees of lower & middle level cadres in field formation. Acute stagnation has generated a feeling of discontentment in the Central Government Employees.

In spite of that 6th CPC has overlooked all the facts & recommendations in respects of the much sufferer employees and recommended two financial upgradations in the Grade Pay hierarchy after 12 and 24 years. The recommendations were not justified. Most of the lower & middle level cadres in field formation are suffering from acute stagnation. While promotion are assured at the upper level, Government is unable to provide even two regular promotions to some section of employees in the lower and middle level during their entire service.

 Although the Government improved upon the recommendations of the 6th CPC and has implemented MACPS with three financial upgradations in the Grade pay hierarchy after 10, 20 & 30 years but in spite of that the Modified ACP Scheme has further diluted their present status of career progression.

The case of the Junior Engineers of Central Water Commission is furnished below-

Due to the ‘shift’ in ‘principles & purposes’ of the Assured Career Progression in the MACPS, the pay scale/Grade pay of the Junior Engineers of Central Water Commission, who have not completed 24 years of service up to 31st August, 2008, will be fixed abnormally on lower side at H 4,800/- instead of  in the grade pay of  H 5,400/-  which is continuously being given to all those JEs, who have completed 24 years of their services up to 31-8-2008 as per erstwhile ACP Scheme.

Hence upgradations under ACP Scheme 1999 were as below

Upgradations under Modified ACP Scheme 2009 are as below

The Junior Engineers who were granted second ACP in the grade of H 5400 in PB-3 up to 31-08-2008, have been awarded 3rd MACP in the Grade of H 6600 on completion of 30 years of regular service. 


Further the Grade Pay of H 4800 is not in the hierarchy of the engineering cadre or any other cadre in Central Water Commission except CSS/CSSS cadres. While recommending the pay structure in respect of CSS/CSSS cadres in Chapter 3.1 at page 161, 6th CPC has mentioned that “The grade carrying grade pay of Rs.4800 in pay band PB-2 is, otherwise, not to be treated as a regular grade and should not be extended to any other category of employees. These recommendations shall apply mutatis-mutandis to post of Private Secretary/equivalent in these services as well.”


It is clear from the above that the implementation of MACP Scheme has downgraded the Junior Engineers & they are getting huge loss due to this modified scheme even after serving such a long time to the Government. The Junior Engineers who could not complete 24 years up to 31-8-2008 will be given 3rd MACP in the Grade Pay of H 5400 in PB-2 on completion of 30 years of regular service whereas their counterparts who had completed 24 years of regular service prior to 1st September, 2008 were awarded the Grade Pay of H 5400 in PB-3 and on completion of 30 years they are getting Grade Pay of H 6600 in PB-3. This will lead to enhance the feeling of discontentment, unprecedented frustration, resentment and agitation in the affected Junior Engineers.

Promotional prospects must be perceived by an employee as being timely. If an employee is made to continue for long years in particular grade, and if he is not made aware that his performance is being reviewed periodically, he is likely to lose the motivation to excel himself. In the long run this would cause permanent irreparable damage to this category. Further it would also give doubt about the recognition of their services & completely demoralized them.

Junior Engineers in Central Water Commission are not getting promotion in the post based system even though they are eligible. For none of their mistake, they are severely punished in their social status as well as financial. In the present circumstances, generating number of promotional avenues under Govt. setup absolutely is not possible. Therefore, only Assured Career Progression may bring great relief to the employees to the larger extent, hence three MACPs in promotional hierarchy is the natural requirement.

          The format of ACP which confers the next promotional grade in functional hierarchy must be restored with three financial upgradations after 10, 20 & 30 years.
 
Therefore the provisions of the MACP Scheme of the VI CPC may be reviewed & distortions may be corrected so as to remove these anomalies and adjudicate provide relief to the suffering cadre of the Junior Engineers in Central Water Commission under Ministry of Water Resources.

MINUTES OF THE THIRD MEETING OF THE JOINT COMMITTEE ON MACPS ISSUED BY DOP&T

Summary record of discussions held during the third meeting of the Joint Committee on MACPS held on 15th March, 2011 under the Chairpersonship of the Joint Secretary (Estt.) DOP&T has been issued. Point no. 1, 3, 8, 9, 29, 2, 7, 20 & 48- Grant of financial upgradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS are given below-

Item numbers 1.3.8. 9 & 29- Grant of financial upgradation in the promotional hierarchy instead of Grade Pay hierarchy under the MACPS.

The Staff Side reiterated their demand that the financial upgradations under the MACP Scheme should be granted in the promotional hierarchy of posts instead of the Grade Pay hierarchy. The Staff Side stated that the erstwhile ACP Scheme was implemented on the recommendations of the 5Ih CPC and, as such, has become a part of the service conditions of the employees. The Staff Side, therefore, contended that the Government cannot impose the MACP Scheme thereby altering the service conditions to the detriment of the employees.

The Official Side stated that the 6th CPC recommended two financial upgradations in the Grade Pay hierarchy after 12 and 24 years. However, the Government improved upon the recommendations of the 6th CPC and has implemented MACPS with three financial upgradations in the Grade pay hierarchy after 10, 20 & 30 years. Referring to earlier discussions held in the matter, the Official Side stated that the Government was willing to consider revision in para 13 of the MACP Scheme to the effect that organisations / cadres shall have the option to choose either the ACP Scheme or MAGP Scheme. However, the Staff Side pointed that such a dispensation will not be practical and hence there is a need to explore other alternatives to solve the issue. After discussion, it was agreed that there is no need to change the basic structure of MACP Scheme. However, there is a need to separately examine those cases where MACP Scheme is less advantageous than the ACP Scheme. Accordingly, it was decided that the Official Side will write to the Ministry of Railways, Defence, Urban Development, Home and the Department of Posts to forward information in respect of the specific categories of employees where the MACPS is less advantageous than the erstwhile ACP Scheme The Official Side also requested the Staff Side to collect and forward such information to the Department of Personnel & Training for further necessary action. In this connection, the Staff Side specifically pointed out the case of Technician category wherein under ACP (w.e.f 1.10.199) the staff got upgradation to Rs.4500-7000 (V CPC) on completion of 24 years whereas under MACPS they get the same benefit, i.e. Grade Pay of Rs.2800 after 30 years.


Item Nos. 2,7,20 8 48- Date of Effect of MACP Scheme

The Staff Side stated that many employees who retired between 1.1.2006 and 31st August, 2008, have been deprived of the benefits of MACP Scheme and therefore, demanded that the MACP Scheme may be made effective from 1.1.2006. The Official Side stated that the matter was discussed and finalised in the second meeting of the Joint Committee and therefore, there was no reason to reopen the matter. After discussions, it was decided that the matter may be treated as finalised so far as the Joint Committee on MACP is concerned and if required, the Staff Side may raise this issue in the next meeting of the National Anomaly Committee.
