In the last circular in June 2010 we had requested all the members to send the e-mail addresses. In response to that only two members had reacted. Many of our friends who are posted at Division / Sub Division head quarters may have the facilities of internet & some of them may have the facility at their residences too. Hence it will be wise to use the modern techniques for communication which would be easy to transmit the messages to other friends who are posted at sites/ field offices. Therefore, it is to request all of you to send your e-mail addresses for easy and quick communication.

The recent developments and other activities of our Associations are given here to keep one and all with updated information.

• Restoration of ACP Schemeof 1999 was rejected by the DOP&T how ever the National Executives of “Confederation of the Central Government Employees and Workers” insisting to discuss the issue once again with DOP&T and Ministry of Finance.
• Promotions from J.E to AD-II/SDE for about 68 vacancies are likely to be released shortly. The DPC has already been held on 20-10-2010. Association had requested CWC Administration to speedup the action to fill up these posts. The process is delayed due to new guidelines of DOP&T. As per new guidelines below benchmark ACRs are to be communicated to the person concerned their representation is to be obtained and a final decision of the competent authority needs to be taken /recorded.
• Pay scale case of 1991 filed in 2001 demanding parity of pay on par with JEs of CPWD is pending before High Court Bench, New Delhi and yet to be heard. The case was listed on 03-01-2010 but not heard. Next date for hearing is awaited.
• Process for I, II & III upgradation under MACP to the eligible JEs for the period ending up to September 2010 is under progress. Please ensure that the information & vigilance clearance in respect of the Junior Engineers who have completed/will complete 10, 20 or 30 years of service as on 30-09-2010 may be sent to CWC.
• Meeting of the Departmental Council (JCM) of MOWR was held on 23-08-2010 under the chairmanship of Secretary, MOWR in which the following agenda pertains to Association of Junior Engineers were discussed-

A. OLD ITEMS
1. Demand to revise the quantum of Investigation Allowance according to VI th CPC recommendations

It was told that CWC had submitted the proposal to MOWR. MOWR has asked some more clarifications. After detailed discussion Secretary, MOWR directed CWC to submit the clarification as required by MOWR.

2. Demand to review the compensatory allowances paid to the employees posted in Joint Project office and engaged in Sapt Kosi Sun Kosi Investigation works in Nepal.

The allowances to the Staff of the CWC has been approved by the MEA at par with the staff of JP Koirala Institute and the same has already been implemented. Staff side thanked for the same.

3. Abolition of Junior Engineers posts in Central Water Commission adversely affecting the field setup.

Recruitment Rules of the Junior Engineer have been notified in the Gazette of India. Now the vacancies of the Junior Engineers will be filled through “Staff Selection Commission”. CWC has requested SSC to fill up 144 posts. Further, the proposal has been submitted to MOWR to revive 156 post of J.Es, which had gone under deemed abolition.

4. Demand to implement ACP to erstwhile Design Assistants Cadre.

ACP orders have been issued. Staff side thanked for the same.

5. Demand to provide medical attendance Scheme for the GOI officials posted at Joint Project Office Sapt Kosi Sun Kosi Investigation, Nepal.

It was reported that the case is pending in the Ministry of Health. Secretary, MOWR directed to expedite the matter.

6. Demand to fill up the promotional posts of Junior Time Scale in Central Water Commission for 2008-09 & 2009-10.

As per new guidelines of DOP&T the process of below benchmark ACRs of AD-II/SDE has been completed. Proposal for filling up of the promotional vacancies caused in AEE/AD posts for the year 2008-10 has been resubmitted to UPSC through MOWR.
Efforts are being made with MOWR & UPSC to fill these posts at the earliest so that the resultant vacancies in the grade of AD-II/SDE would be available for promotion of J.E’s.

7. Demand to amend the promotion hierarchy of Group ‘B’ Engineering cadre directly into Senior Time Scale like the system followed in CPWD.

Secretary, MOWR directed CWC to hold the meeting with the concerned Associations. Accordingly, CWC held the meeting on 20th September, our Association Gr.B-Association (AD II/SDE) had jointly submitted the proposal. Further detailed discussion will be held soon.

8. Time frame to settle the pension payment and other retirement dues of the field staff.

Staff side has expressed their unhappiness in the undue delay in the pension related payments to the retiring staffs. After detailed discussion it was decided that the name of the persons, retiring will be submitted six months in advance. Secretary asked JS &FA, MOWR to hold the meeting with Controller of Accounts, MOWR and officers of the affected departments & monitor the progress of the pension cases.

9. Demand to maintain GPF account on Web Site and to take appropriate action on missing credits.

It was reported by the Controller of Accounts, MOWR that request has been made to NIC to provide software for putting the GPF account on Website. As soon as the software is received the GPF accounts will be placed on the Web Site.

B. NEW ITEMS
1. Demand to enhance the allowance to the CWC employees serving at Bhutan/Neapl at par with the Staff serving in External Affairs Ministry.

Proposal for the revision of Pay Scale and allowances to the CWC staff working at Bhutan at par with other officials posted at Bhutan has been accepted by the MOWR. Secretary, MOWR has directed CWC/MOWR administration to take up the matter with the MOF and MEA.

It further reiterated that –

• Where ever Regional Council meeting is not held or necessary to hold may be brought to the notice of the Association.

• The missing credits in GPF cases & delay in service verification may please be brought to the notice of Association for needful action.

• Interested members may suggest points connected to service matters, please write immediately, your suggestions are most welcome, it would be a valuable and helpful us to project it in the appropriate forum. Be sportive and feel to fight for the common cause of our cadre.

You are requested to pass on a copy of circular to all the JEs working under your Division/Branch, as frequent complaints are being received for non receipt of the circulars from the Junior Engineers who are at sites.

DPC held for promotion of the Junior Engineers in CWC

DPC for the promotion of the Junior Engineers has been held yesterday ie on 20-10-2010. It is learnt that 68 posts of AD-II/SDE are likely to be filled. Orders will be issued shortly.

Dear Comrade,

The 2nd meeting of the MACP Committee was held on 15th September, 2010. The meeting was chaired by the Joint Secretary (Estt.) Department of Personnel and Training. We give hereunder a brief resume of the discussions taken up by the Staff Side on the points related to us and as reported by the Confederation of Central Governemnt of Employees & Workers.

It has been reported that the demand to provide for Grade Pay of the next promotional post under MACP as was given in the old ACP Scheme has not been agreed by the DOP&T.

In respect of other alternate demand for Option for each individual employee either to retain the old ACP scheme or to switch over to MACP, it was only agreed by the DOPT that they may consider giving option to the Department and not to the individual employee to retrain old ACP Scheme in respect of either the entire establishment of that Department or for a specific category or cadre of the employees of that Department. They also added that they may instruct the Administrative department to undertake restructuring of the cadres in consultation with the Staff Side which would secure quicker promotion.

This is painful that the DOP&T has not agreed to the demand to provide for Grade Pay of the next promotional post under MACP as was given in the old ACP Scheme. Option to the department will not serve any purpose. We have written to the Confederation to take up the matter once again. Copy of the letter is placed hearunder-

Sub.: 2nd meeting of the MACP Committee held on 15th September, 2010.

Your kind attention is invited to the circular no 19 dated 26th September, 2010 of the confederation wherein the discussions, made in the 2nd meeting of the MACP Committee held on 15th September, 2010, have been intimated. In this connection it is to request that the following agenda item may kindly be taken up again and the DOP&T may be requested to consider the demand once again.

1. Item No. 1, 9 & 29, 46:
The demand was to provide for Grade Pay of the next promotional post under MACP as was given in the old ACP Scheme. This has not been agreed to.

This is a very important item and the same is affecting most of the cadres. Due to Rejection of this demand many cadres will suffer. Most sufferers are Junior Engineers, ministerial staff of subordinate offices, survey staff, scientific staff drilling staff etc and many more. Hence it is our humble request that the item may please be taken up once again.

2. Item No.3:
Option for each individual employee either to retain the old ACP scheme or to switch over to MACP. It was only agreed by the DOPT that they may consider giving option to the Department and not to the individual employee to retrain old ACP Scheme in respect of either the entire establishment of that Department or for a specific category or cadre of the employees of that Department. They also added that they may instruct the Administrative department to undertake restructuring of the cadres in consultation with the Staff Side which would secure quicker promotion.


If the provision of the option to the Department is allowed, it will again create an anomaly. Due to implementation of the MACP Scheme a huge gap was created between the seniors & juniors i.e. the employees who had been awarded 2nd ACP up to 31-08-2008 on completion of 24 years of regular service and the employees who had not completed 24 years of regular service and become eligible for 1st or 2nd financial upgradation in the immediate next grade pay under MACP instead of promotional grade pay. The purpose of the submission of the agenda in the anomaly committee was to remove the gap and to bring the later at par with the seniors. Now after implementations of MACP Scheme, during the last two years after 1-09-2008 many of the employees have been awarded 3rd MACP on completion of 30 years of service. In case of option the employees who had yet not completed 30 years of service will be deprived from third MACP and will get only two upgradations under ACP. Hence the situation & agitation will remain the same.

As far as “instruction to the Administrative department to undertake cadre restructuring of the cadres in consultation with the Staff Side which would secure quicker promotion” is concerned there is no certainty in the assurance. The restructuring is to be initiated by the respective departments & there is no time limit for the process. So many cadre restructuring & cadre reviews are lingering on since many years. The process of objections, comments and compliance is going on. Employees are being retired on superannuation but their hope is still remaining a hope. Despite instructions from the government nobody bother about the group ‘B’ ‘C’ & ‘D’.

In the above circumstances, to bring the employees at par altogether, three upgradations in the promotional hierarchy is the only appropriate solution.

Therefore, you are requested to please take up the demand once again for further consideration otherwise the affected employees will suffer badly for ever.
