AGENDA ITEMS FOR DISCUSSION IN THE 35TH MEETING OF DEPARTMENTALCOUNCIL (JCM), MOWR SUBMITTED

Association has submitted following agenda items for discussion in the 35th meeting of Departmental Council (JCM), MOWR.

1. Demand to implement MACP Scheme to promotee Asst. Executive Engineer / Assistant Directors in Central Water Commission.

The MACP Scheme is yet to be implemented to Junior Engineers / D.A who have been promoted as AEE /AD in CWC.On enquiry, the CWC informed to the individuals that the benefits under MACP Scheme is not applicable to promotee AEE /AD as they have been later on inducted to the Organised Group ‘A’ service.

Time and again the issue was discussed and also raised in the opening remark by the Leader, Staff Side on 23/08/2010 during the 34th Departmental Council meeting .It is clear that the promotee officers appointed into Gr-C service and promoted into Gr-A after rendering 31/32 years service. Virtually no financial benefit has been drawn at that position, as they had already been placed in the pay scale through ACP.

Now all their juniors have been awarded 3rd MACP in the grade pay of Rs.6600/- where as the AD/AEE are drawing Rs.5400/-.The promotion to the grade of AEE/AD has come as a punishment as they are placed in the lower grade than their juniors. The benefits/facilities provided to Organised service persons are harvested only by the direct recruit officers. The promotee officers are not having sufficient length of service to get any facility

It is there fore requested that awarding MACP to promotee AEE/AD may be taken up with appropriate authority for favourable decision.

2. Demand to change the crucial date for determining eligibility as 1st April instead of 1st January in Central Water Commission.

The DOP& T had given the option to employers Ministry/Department to fix the crucial date to determine the eligibility for promotion. At present MOWR/CWC is considering 1st January as crucial date for determining the eligibility. In this connection it is to inform that we experienced that the proposal for promotions submitted in July/August or October/ November to UPSC are being considered for DPC generally after January and never been taken the proposal in December. By such delay the promotees are loosing that particular year for counting the service for their next promotion.

Most of the promotee officers are deprived of their next promotion on above reason/logic. There fore it is to demand that the CRUCIAL DATE be considered for change from 1st January to 1st April so that there wont be any time loss for considering their promotion.

3. Demand to implement MACP Scheme to the erst while Design Assistants and present AD-II/ SDE in CWC.

The Design Assistants had been awarded 1st ACP w.e.from 01/01/2006 as per the decision taken in the 33rd Departmental Council meeting. Now all are eligible for 2nd MACP as per the revised scheme. But so far they have not been awarded the MACP in spite of their repeated request. The reason for not
awarding is also not given. It is there fore demanded that the MACP be awarded to the eligible officials with out any further delay.

4. Demand to with draw the Departmental Test Conducted by CWC at AD II / SDE and AD/AEE level.

The existing procedure in CWC is that the AD II/AD has to clear the Department Test including technical and Accounts papers compulsorily before getting promotion as DD/EE (STS)posts. Such procedure is not prevailing in any other department including CPWD. For each and every thing CPWD is taken as bench mark. The Recruitment Rule and Accounts procedure mostly followed on common line. The departmental test conducted at fag end for DPC candidates may not going to help at all and for conducting technical exam to UPSC selected candidates once again also not having any sense. The Accounts procedure test alone if felt necessary can be conducted. The technical papers may be dispensed please.

5. Classification of post as per DOP&T OM No.1101217/2008-Estt. (A) 17th April, 2009.

As per DOPT OM No.1101217/2008-Estt. (A) 17th April, 2009 all the Central Civil Services posts into Group "A", "B", "C" and "D" based on the revised norms of pay has been classified w.e.f. 9th April 2009 vide Gazette notification no.- S.O. 946 (E) dated 09.04.2009 published in the Gazette of India Extraordinary.

But contrary to that Central Water Commission vide office order no. H-2018/7/2009-Estt.VI/949 dated 19-07-2010 has reclassified the post of the Junior Engineer as Group ‘B’ w.e.f. the date of the order i.e. 19-07-2010. The order of the Central Water Commission is in violation of the DOP&T guidelines. Although other cadres such as Scientific, Statistical, Drawing, Ministerial & Workchrged in Central Water Commission have been reclassified w.e.f. 09-04-2009.

The matter was discussed in the 34th meeting of Departmental Council. After having detailed discussions on the matter the Chairman of the Council has decided that direction to that effect would be issued from the ministry so that all the posts under the MOWR can be reclassified uniformly in accordance with DOP&T direction. But since then, no action has yet been taken. Therefore it is to demand to make suitable direction so that the post of the Junior Engineer in Central Water Commission can be reclassified as Group ‘B’ Non Gazetted w.e.f. 09-04-2009.
